Terms and Conditions

Thank you for choosing Clinton Driving School, proudly serving Ontario with licensed, experienced instructors and a commitment to safe, responsible driving education. These Terms and Conditions (“Terms”) outline the legal agreement between you (“student,” “you,” or “your”) and Clinton Driving School (“we,” “our,” or “the School”). By using our services, including driving lessons, in-car instruction, and access to our website and digital resources, you agree to be bound by these Terms. If you do not agree, please refrain from using our services.

 

1. Eligibility to Use Our Services

To use our services, you must be at least 16 years old and hold a valid Ontario G1, G2, or full G license (or an equivalent license recognized in Ontario). You agree to provide accurate, complete, and up-to-date information upon registration and to notify us of any changes to your licensing status or contact details.

If you are signing up on behalf of a minor or another person, you confirm that you have the legal authority to do so.

 

2. Safety and Responsible Conduct

Clinton Driving School prioritizes safety above all else. Distracted driving—including the use of phones or mobile apps during a lesson—is strictly prohibited. Any apps or navigation aids must be set up before the vehicle is in motion and should not interfere with safe operation of the car. You are expected to act responsibly behind the wheel, follow all traffic laws, and listen to your instructor at all times.

We are not liable for any accidents, infractions, or damages resulting from student negligence, distraction, or failure to follow instructions.

 

3. Prepaid Lessons and Credit Validity

All driving lessons must be prepaid. Upon payment, your account is credited with a designated number of lesson hours, typically sold in 2-hour increments at a rate of $50/hour (i.e., $100 per session).

Lesson credits are valid for 6 months from the date of purchase. Any unused hours after this period will expire. Expired lessons may be reactivated at a reduced rate of $60 per 2-hour session. This reactivation fee applies only to expired lessons and does not apply to rescheduling or late cancellation penalties.

 

4. Refund Policy

We aim to provide fair, transparent, and efficient refunds.

You may request a refund within 75 days of your purchase. Refunds are calculated based on the number of hours used and the original hourly rate of $50/hour. Partial refunds are available based on what services were actually rendered.

Example:
If you purchase 8 hours (four 2-hour sessions) for $400, and complete two sessions (4 hours), you will be refunded for the unused 4 hours:

  • 4 hours × $50/hour = $200 refund

A $50 processing fee will be deducted from all refunds, regardless of how many lessons were completed. Refunds will be issued to the original payment method within 1 business day of approval. Please allow additional time for your financial institution to process the return.

To request a refund, email us at contact@ClintonDrivingSchool.ca with your name, purchase date, and reason for the request.

 

5. Cancellations and Rescheduling

We understand that life happens, but last-minute changes affect our instructors’ schedules. Please follow our cancellation policy:

  • 48+ hours before the lesson: Free cancellation or reschedule

  • 1 to 48 hours before: $40 late change/cancellation fee

  • Less than 1 hour / No-shows: Full session fee is forfeited

You must notify us via phone, text, or email. Repeated late cancellations or no-shows may result in the suspension of services.

 

6. Service Adjustments

We reserve the right to modify lesson offerings, schedules, availability, or pricing without prior notice. If a lesson must be canceled due to instructor illness, vehicle maintenance, or weather conditions, we will reschedule at no cost.

Continued use of our services after changes have been made indicates your acceptance of those changes.

 

7. Limited Satisfaction Policy

Clinton Driving School is committed to delivering high-quality instruction. However, we do not guarantee that you will pass your driving test or reach proficiency within a set number of lessons. Progress varies from student to student.

If you feel a specific lesson did not meet your expectations, please contact us within 24 hours of that session. At our discretion, we may:

  • Provide a complimentary makeup lesson with a different instructor, or

  • Offer a refund for that particular session

This satisfaction guarantee applies to one session per student and is not intended as a general refund policy.

 

8. Legal Liability Disclaimer

All driving lessons are conducted in insured training vehicles. However, Clinton Driving School is not responsible for:

  • Accidents or property damage occurring outside our training sessions

  • Personal injury or loss during transit to/from lessons

  • Traffic tickets, fines, or legal infractions caused by the student

You agree to assume full responsibility for your actions during and after lessons.

 

9. Dispute Resolution and Waiver of Class Actions

By using our services, you agree that any dispute or claim relating to Clinton Driving School shall be resolved through binding individual arbitration, and not in court. You waive the right to a trial by jury and agree not to participate in any class action or representative proceeding. Exceptions to this agreement include small claims matters, regulatory agency actions, and urgent legal actions such as injunctive relief. This clause applies to all current and future disputes unless explicitly waived in writing.

 

10. Indemnity Agreement

You agree to indemnify, defend, and hold harmless Clinton Driving School, its instructors, staff, affiliates, and partners from any claims, losses, damages, or legal fees arising from:

  • Your misuse of our services

  • Violations of the Highway Traffic Act

  • Breach of these Terms

  • Any incident resulting from unsafe, negligent, or unlawful driving behavior

This clause survives termination of your use of services.

 

11. Governing Law

These Terms are governed by the laws of the Province of Ontario. Any legal matters or claims must be brought within Ontario’s jurisdiction.

 

12. Severability and Entire Agreement

If any part of these Terms is found invalid or unenforceable, the remainder shall still be enforceable. These Terms, along with our Privacy Policy, represent the full and final agreement between you and Clinton Driving School. Any prior understandings, whether oral or written, are hereby void.

 

13. Conclusion 

At Clinton Driving School, we believe in transparency, respect, and clear communication. This document, along with our Privacy Policy, outlines everything you need to know about using our services. Any future changes will either be published right here or officially confirmed by one of our team members in writing.
